Civil Division Expand

All fees herein are established in accordance with La. R.S. 13:841 (as amended by Act No. 243 of the 2006 Regular Legislative Session) and other relevant statutes.  This fee schedule is intended only as a guide in estimating costs. For assistance with calculating costs for your pleading or filing, call (504) 934-6610.  However, please realize that every pleading is different and may include the need for services or include attachments or other documents that may increase the cost to process accordingly.  At any time during litigation, any party may request and obtain a copy of the docket ledger.  The following schedule of fees has been adopted by this office for civil suit filings in Plaquemines Parish.

Please note that the cost of a new suit includes these fees which are NOT retained by the clerk of court and may change without notice or pursuant to Legislative Act:  Judges Supplemental Compensation Fund [La. R.S. 13:10.3(C)]); Judicial Expense Fund [La. R.S. 13:994(A)]; Stenographers [La. R.S. 13:972(I)]; Supreme Court Reporting System [La. R.S. 13:841.1]; Supreme Court Civil Case Reporting [La. R.S. 13:4688(B)]; and Service (Agent of Process). 

Many sheriffs’ offices require a separate check for service to be made in their parish.  A list of sheriffs who require separate checks appears below.  Make checks payable to that parish’s sheriff.  Fees for service in parishes not listed below will be deducted from your advance deposit reserve.  A separate check for service is not required for e-filed pleadings; the cost will be deducted from your advance deposit reserve.

New Suit Filings

In some instances, a larger advance deposit may be required for litigation that includes multiple plaintiffs or defendants and lengthy pleadings.  These advance deposit amounts are only a guide, and typically include only one service.  With few exceptions, the following new suit and domestic suit costs include one service. 

Subsequent Suit Filings

When filing a pleading or other documents into a suit that has already been established, one must consider many factors when determining cost, as every pleading is different. A filer should consider these when attempting to estimate costs: 1) pages to the pleading; 2) pages of exhibits; 3) litigants filer is requesting to be served; 4) certified copies the clerk will need to perform issuing; 5) number of litigants to be indexed (new suits only); 6) number of litigants to be served, etc. The base filing fee for any pleading is $6 for the first page and $4 for each additional page. Some pleadings require deposit of extra funds due to nature of services to be rendered.

Criminal Division Expand

Pursuant to La. R.S. 13:847 and La. R.S. 44:9, the Plaquemines Parish Clerk of Court is entitled to collect fees for services performed by its criminal records division clerks.  Fees for filings enumerated in the statute are collected post-conviction by the Plaquemines Parish Sheriff from defendants who have been cast with fines.

The clerk of court’s office provides copies and services to law enforcement agencies (government) and to indigent defendants and their attorneys at no charge. The general public, defendants who are not indigent or who have not been placed on a inmate payment plan, and attorneys who are not representing an indigent defendant are required to pay for the following services.

Photocopies [La. R.S. 13:847(A)(3)]: $1.00 per page;

Conformed copies (clocked, not certified) [La. R.S. 13:847(A)(4)]:  $3.00 per copy;

Certification of copies [La. R.S. 13:847(A)(5)]:  $5 per copy (in addition to applicable copy costs);

Criminal history search [La. R.S. 13:847(A)(6)]:  $20 per search (one name per search);

Extract of court minutes [La. R.S. 13:847(A)(7)]:  $10 ($15 certified);

United States Postal Service and common carriers, costs actually incurred [La. R.S. 13:847(A)(8)]: Minimum cost:  $.50 per mailing, subject to change without notice.

Fax Filing:  Pursuant to La. Code of Criminal Procedure Article 14.1(3), the Plaquemines Parish Clerk of Court is entitled to collect a $5 transmission fee for documents transmitted to the office for filing via facsimile in addition to service fees enumerated in La. R.S. 13:847.

EXPUNGEMENTS

Felony or Misdemeanor Expungements – Total Amount $550.00

• $200.00 payable to Plaquemines Parish Clerk of Court – Payment may be made by cash, check (business/personal), credit card, or U.S. Postal Service money order.
• $250.00 payable to Louisiana State Police – Payment must be made by U.S. Postal Service money order.
• $50.00 payable to Plaquemines Parish District Attorney – Payment must be made by U.S. Postal Service money order.
• $50.00 payable to Plaquemines Parish Sheriff – Payment must be made by U.S. Postal Service money order.

DWI Expungements – Total Amount $600.00

• $200.00 payable to Plaquemines Parish Clerk of Court – Payment may be made by cash, check (business/personal), credit card, or U.S. Postal Service money order.
• $250.00 payable to Louisiana State Police – Payment must be made by U.S. Postal Service money order.
• $50.00 payable to Plaquemines Parish District Attorney – Payment must be made by U.S. Postal Service money order.
• $50.00 payable to Plaquemines Parish Sheriff – Payment must be made by U.S. Postal Service money order.
• $50.00 payable to Louisiana Office of Motor Vehicles – Payment must be made by U.S. money order.

EXPUNGEMENT FEES ARE NONREFUNDABLE – EVEN IF EXPUNGEMENT IS DENIED (La. C.Cr.P. Art 983)

Please note: Applicants must also obtain a Review of Record from the Plaquemines Parish Sheriff’s Office, 8022 Hwy. 23, Belle Chasse LA (504) 564-2525. The fee for a Review of Record is $50.00 (non-refundable, cash only). The Review of Record must be obtained within 60 days prior to filing the expungement.

Mortgage & Conveyance (Recording) Expand

These fees include all parts of the act to be recorded plus all attachments including but not limited to exhibits, riders, powers of attorney, property description exhibits, tax certificates and researches, mortgage and conveyance certificates, resolutions, certificates, and surveys.  If any of the pages is greater than 8 1/2″ X 14″ (legal size), add $20.00 per oversized page.

Services included in the costs above include 1) one certified true copy of the recorded document OR e-certification of document; 2) indexing of all names up to ten names.

The fees above are for one book only (ex. conveyance or mortgage only); if you request your document receive multiple book designations (ex. mortgage and conveyance), multiply the costs above by the number of book designations the document is to receive.

Every document filed for recordation shall be captioned as to type of act on the first page, and shall have on the first page a margin of two inches at the top and one inch at the bottom and sides.  The type size shall not be less than eight point.

Pursuant to La. R.S. 13:754, clerks of court participate in the Louisiana Clerks Remote Access Authority (LCRAA) and collect the authorized $5 per recording fee. The fee is charged once per instrument (Notices of Repossession and Cancellation of one mortgage inscription by paraphed promissory note excepted) regardless of the number of book classifications a document receives. The fees above include this charge.

Affidavit of Identity (La. R.S. 9:5503): 

First Page:                           $18.00

Notice of Repossession (La. R.S. 6:966.1): $75.00 (regardless of page count)

Other Fees:

Name Indexing (after 10 names):  $5.00 per name (Pursuant Louisiana law, the clerk indexes the maiden and previous married names of females in addition to all variations provided in the document.)

Social Security No. Compliance Fee (La. Code of Civil Procedure Art. 1922 & 3352) [All money judgments and liens must contain last four digits of debtors’ social security number or this charge will be applied]: $25.00 per debtor

Certificate of Cancellation: $10.00 per MOB inscription

Conformed Copy: $5.00 per copy

Photocopies: $1.00 per page

Certified Copies: $10.00 per copy in addition to photocopy fees

Mortgage Certificates:     

First Name: $20.00

Each Additional Name: $10.00

Each Additional Exception (after 10): $1.00 per exception

Lien & Privilege Certificates:

UCC (Universal Commercial Code) Expand

Fees for recording UCC documents are charged in accordance with Louisiana R.S. 10:9-525 and other relevant statutes. A portion of these fees is paid by the clerk of court to the Louisiana Secretary of State, who maintains the statewide UCC database. Birth & Death Certificates Expand

Fees for birth and death certificates are set by the Louisiana Legislature. The fees below include fees the clerk of court pays to the Louisiana Bureau of Vital Records. These are payable to Plaquemines Parish Clerk of Court – Payment may be made by cash, check (business/personal), credit card, or U.S. Postal Service money order.

Birth Certificate: $34.00

Birth Certificate w/Birth Card: $48.00

Death Certificate: $26.00

Marriage Licenses Expand

The cost to obtain a marriage license is $35.00. Certified copies of a marriage license are $10.00 each; un-certified copies of marriage licenses are $5.00 each. By Louisiana law, the clerk of court transfers $12.50 of the above fees to the program for the Program of Victims of Family Violence.

Passports Expand

Fees are established by the U.S. State Department.  The cost for a new passport is $130.00 for those age 16 and older, and is valid for 10 years from the date of issue. The cost is $100.00 for those age 15 and younger, and is valid for 5 years from the date of issue. Fees are payable in check or money order only to: “U.S. Dept. of State.”

A $35.00 execution fee per passport, payable in cash, money order, or check is due the clerk of court. The clerk of court, however, is preparing to implement a credit card alternative to cash. The fee for the clerk of court’s passport photo service is $10.00. Checks and money orders for fees due the clerk of court should be made payable to “Plaquemines Parish Clerk of Court”.

The clerk of court may assist with completion of renewal forms, but the passport holder must mail the renewal form, fees, and expired/expiring passport directly to the U.S. State Dept. Children’s passports (if issued under age 15) cannot be renewed; a new passport application is required. The passport renewal fee is $130.00 per passport for standard service.

The clerk’s $35.00 execution fee does not apply to renewals, but the fee for the clerk of court’s passport photo service is $10.00. Checks and money orders for fees due the clerk of court should be made payable to “Plaquemines Parish Clerk of Court”.
